Terms and Conditions

1. Introduction

These Terms and Conditions govern the relationship between Ángela Belencoso Palomeque, with registered address at Carrer Escoles Pies 66, 08017 Barcelona, Spain, and Tax ID (NIF) 24391262-S, hereinafter referred to as “KIT”, and users of the website www.kitforlearning.com, hereinafter referred to as the “Website”.

By using the Website and completing the registration process for any of the Courses offered by KIT, the user agrees to be bound by these Terms and Conditions.

2. Registration Requirements

To enrol in a Course, the user must be at least 18 years old and complete the online registration process by providing accurate, complete and up-to-date information.

KIT reserves the right to cancel a registration if the information provided is incorrect, incomplete or fraudulent.

3. Payment Process and Change, Cancellation and Refund Policies

3.1. Payment Methods

Payment for the Courses must be made through the payment methods available on the Website, processed through the Stripe platform. The cost of the Course will be the amount specified at the time of registration.

3.2. Change, Cancellation and Refund Policy

We understand that unforeseen circumstances may arise. For this reason, KIT offers different cancellation or change options depending on when the request is made.

3.3. Right of Withdrawal

Where applicable, students may exercise their statutory right of withdrawal within 14 calendar days from the date of entering into the contract, in accordance with applicable legislation, and request a refund of the amount paid.

3.4. Cancellations After the Withdrawal Period

Once the statutory withdrawal period has expired, the following conditions will apply:

More than 14 calendar days before the Course begins: the amount paid may be converted into credit for 100% of its value, valid towards another KIT Course or training programme within the following 12 months. No monetary refund will be issued.

Between 14 and 8 calendar days before the Course begins: the registration fee is non-refundable. Where possible, KIT may offer a transfer to another Course or credit towards a future training programme.

During the 7 calendar days prior to the start of the Course: the registration fee is non-refundable and cannot be converted into credit, except in exceptional circumstances, which KIT may assess on a case-by-case basis.

Once the Course has begun: no refunds or credits will be issued due to non-attendance, withdrawal from the Course or the student's inability to attend one or more sessions.

3.5. Transfer to Another Participant

Before the Course begins, the student may request to transfer their place to another person at no additional cost, provided that KIT is informed in advance and the necessary details of the new participant are provided.

3.6. Cancellation by KIT

If KIT cancels a Course, for example, because the minimum number of participants has not been reached or due to other circumstances that prevent the Course from taking place, the student may choose between a full refund of the amount paid or using that amount as credit towards another KIT Course or training programme.

These conditions apply without prejudice to any rights the consumer may have under applicable legislation.

3.7. Access to Course Content

Registration provides access to the content, materials and resources associated with the Course under the conditions and for the period specified by KIT for each training programme.

Access to Course content does not alter the change, cancellation and refund conditions set out above or any statutory rights applicable to the student.

4. Changes and Cancellations of Courses

4.1. Changes

KIT reserves the right to modify Course dates, schedules, content or other organisational aspects when exceptional circumstances require it.

If any significant changes are made, KIT will inform affected students as far in advance as reasonably possible.

4.2. Cancellation by KIT

If KIT cancels a Course, for example, because the minimum number of participants has not been reached, students will be offered the option of receiving a full refund of the amount paid or transferring their registration to another Course.

4.3. Changes to Teaching Staff

For organisational or professional reasons, availability issues or circumstances beyond its reasonable control, KIT may make changes to the teaching staff of a Course.

Where possible, KIT will inform students of such changes in advance and will endeavour to ensure that the professional profile of any replacement instructor is appropriate for the content and objectives of the Course.

5. Intellectual Property

All content provided during the Courses, including materials, documents, presentations, videos, resources, exercises and any other content provided by KIT or the teaching staff, is protected by intellectual property rights.

These materials are provided exclusively for the student's personal and educational use.

Their reproduction, distribution, public communication, modification, sale or use for commercial purposes is not permitted without the prior express authorisation of the relevant rights holder.

6. Student Obligations

Students agree to use the Website, the platforms used to deliver the Courses and the materials provided responsibly and in accordance with applicable legislation.

Students must also respect the teaching staff, other participants and the dynamics established during the sessions.

KIT reserves the right to restrict or cancel access for any student whose behaviour is inappropriate, offensive or significantly interferes with the proper delivery of the Course.

7. Liability

KIT undertakes to provide its educational services in accordance with the description and characteristics specified for each Course.

However, KIT will not be responsible for technical problems, connection interruptions, software or hardware incompatibilities, or any other circumstances beyond KIT's control that prevent the student from accessing or participating properly in the sessions.

Students are responsible for ensuring that they have an appropriate internet connection, equipment and software required to participate in the Course, where applicable.

KIT cannot guarantee any specific professional, employment or financial results arising from participation in its Courses.

8. Indemnification

The user agrees to indemnify and hold KIT harmless against claims, liabilities, damages, losses or expenses arising from improper use of the Website or the materials provided, or from a breach of these Terms and Conditions.

9. Force Majeure

KIT will not be liable for any failure or delay in fulfilling its obligations where such failure or delay results from force majeure or circumstances beyond its reasonable control.

In such cases, KIT will endeavour, whenever possible, to provide an alternative solution that allows the training to continue or be rescheduled.

10. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law.

Any dispute relating to the interpretation or application of these Terms and Conditions will be resolved in accordance with applicable consumer protection legislation and before the courts and authorities with jurisdiction under such legislation.

11. Cookies

The Website uses cookies and similar technologies to ensure its proper functioning, analyse the use of the Website and, where applicable, provide content or communications tailored to users.
